User Conduct

You agree not to:

• Use the App for any unlawful purpose or in any way that could harm others
• Submit false or misleading information

Intellectual Property

Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will cease immediately.

Foda: Calorie Tracker is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the App, including but not limited to:

• The accuracy, completeness, or reliability of any content or nutritional data provided by the App
• The operation of the App without interruption or error
• The correction of any defects or errors in the App

Limitation of Liability

To the fullest extent permitted by applicable law, Foda: Calorie Tracker and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or other harmful code transmitted to or through the App
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions. Any dispute arising from these Terms or the use of the App shall be resolved in the courts of the United States of America.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
